Abstract

This paper stresses the shift occurred at the beginning of the 13rd century, in judicial proceedings, from the accusatio of Roman legal tradition to the inquisitio. Due to this upset, trials were instituted per publica vox et fama, i.e. on the grounds of the bad reputation one had in his/her community. As far as women and their history are concerned, the focus is centered on adultery, which is the slanderous crime-sin accusation considered by both laws and public opinion, by writers and other makers of male discourse on women’s good-bad reputation. - Questo contributo mette in evidenza l’importanza, nei procedimenti giudiziari, del passaggio avvenuto all’inizio XIII secolo dalla tradizione giuridica romana della accusatio alla inquisitio; a seguito di questo sovvertimento i processi furono istruiti per publica vox et fama ovvero per la cattiva fama che un soggetto aveva nella comunità in cui viveva. Per quanto riguarda le donne e la loro storia, il focus dell’articolo è centrato sull’adulterio che costituisce l’infamante colpa-reato cui guardano tanto le leggi che la pubblica opinione, gli scrittori e gli altri artefici del discorso maschile su fama-infamia delle donne.
